Key Matters

1. The Central Bank of Kenya (CBK)

(The monetary authority of Kenya) in successfully defending CBK’s demonetization, procurement, and issuance processes of the new currency (notes and coins) before the Court of Appeal and Supreme Court. This was a matter of great economic and national significance.
(One of the largest banks in East Africa with assets of USD 11 billion) in a claim by Kenya’s Banking, Insurance, and Finance Union seeking orders that a wide range of the bank’s employees were unionized employees and thus the bank was required to pay monthly agency fees to BIFU.
In an employment matter in connection with the alleged wrongful termination of three South Africans and one Canadian. The claim sought was for over USD 1.5 million (KES 202.5 million) in damages.
In a matter before the Public Procurement Review Board on an alleged breach of the Public Procurement and Asset Disposal Act by a bidder in a tender for the provision of security services.
In a matter before the Public Procurement Review Board and the High Court where the applicant had filed an appeal in the form of a judicial review. The applicant alleged that CBK had failed as the procuring entity to undertake a proper evaluation of the tender (for the provision of maintenance and related services) and was in breach of the Public Procurement and Asset Disposal Act.
In a copyright case where the plaintiff claims to have come up with an original idea/concept of interbank transactions which he allegedly registered with the Kenya Copyrights Board and had a certificate of registration issued Additionally, the plaintiff alleged to have registered another concept of using software to conduct banking services at the comfort of a person’s phone with the alleged certificate of registration being issued. For the alleged infringement of the impugned copyrights the plaintiff sought compensation in terms of general damages at USD 7.4 million (KES 1 billion)
In an environmental matter based on alleged environmental pollution and the challenging of an Environmental Impact Assessment license.
(One of East Africa’s leading FMCG manufacturers) in a Tax Appeal against the demand from the Kenyan Commissioner of Customs Services valued at USD 10 million (KES 1.4 billion).
In connection with an Appeal before the Tax Appeals Tribunal after the Kenya Revenue Authority, demanded payment of more than USD 9.6 million (KES 1.3 billion).
In a matter concerning the collapse of Imperial Bank (one of Kenya’s biggest and most publicized bank fraud schemes).
